the biker may have been a little close but he was well placed for the car driver to see him in his mirror long before he overtook and there should have been no surprise on part of the car driver when he did. Car driver was either half asleep or it was deliberate - either way, he owes a right of care to everyone else on the road, regardless of what they ride or drive reply
